End-User License Agreement

IMPORTANT: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE INSTALLING OR USING THE SOFTWARE.
This End-User License Agreement ("EULA") is a legal agreement between you and Colorant, LLC ("Licensor", "Colorant") for the Colorant software product, which includes the application, associated media, and documentation (the "Software"). By installing, copying, or otherwise using the Software, you agree to be bound by this EULA. If you do not agree, do not install or use the Software.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live (whichever is greater), and able to enter into a binding contract, to install or use the Software.
2. Grant of License
Subject to this EULA, Licensor grants you a limited, non-exclusive, non-transferable license to:
- Install and use the Software on the computer(s) you own or control as needed to run Colorant as documented, including the two-computer (dual-PC) configuration described in the setup guide;
- Use the Software for your personal, non-commercial use in accordance with the documentation.
3. License Types and Activation
3.1 License Types
- Standard License: grants usage rights for a specified period.
- Lifetime License: grants usage rights for as long as Colorant continues to operate the relevant Services.
3.2 Activation and Authentication
- The Software requires online activation and periodic authentication to verify your license.
- Each license is tied to your hardware configuration through Hardware Identification (HWID).
- The Software may collect and transmit HWID and other authentication data to Licensor's servers during installation, activation, and use, as described in the Privacy Policy.
4. Other Rights and Limitations
4.1 Maintenance of Copyright Notices
You must not remove or alter any copyright or proprietary notices on any copies of the Software.
4.2 Distribution
You may not distribute, rent, lease, lend, sell, sublicense, or otherwise transfer the Software to any third party.
4.3 Reverse Engineering
You may not reverse engineer, decompile, or disassemble the Software, except and only to the extent that applicable law expressly permits despite this limitation.
4.4 Modification
You may not modify, adapt, or create derivative works based on the Software.
4.5 Single User
Each license is for a single user and is tied to your hardware (HWID). A single license covers one user's setup, including the dual-PC configuration. A license may not be shared between different people, and additional users require additional licenses.
4.6 No Improper Separation
The Software is licensed as a single product. You may not separate its components in order to circumvent licensing or to make the Software available to additional users.
4.7 Software Transfer
You may not transfer your rights under this EULA to any third party.
4.8 Compliance with Third-Party Terms
You are solely responsible for ensuring that your use of the Software complies with any applicable third-party terms of service, including those of games and other platforms. Licensor is not responsible for any violation of third-party terms resulting from your use of the Software.
5. Intended Use
The Software is designed specifically to assist users who experience difficulties with precise mouse movements, including:
- Users who lack the natural dexterity or skill level required for high-performance gaming
- Users with cognitive, neurological, or developmental conditions that affect fine motor control
- Users seeking accessibility solutions to overcome barriers in applications requiring advanced cursor precision
- Users requiring assistive technology to achieve parity with typical performance levels in competitive environments
Important: Software that interacts with online games may breach those games' terms of service or anti-cheat rules, and using it can result in temporary or permanent bans of your game accounts. You use the Software at your own risk, and Licensor is not responsible for decisions made by game publishers or platforms.
6. Intellectual Property
6.1 Ownership
The Software is protected by copyright and other intellectual property laws and treaties. The Software is licensed, not sold. Licensor retains all right, title, and interest in and to the Software, including all intellectual property rights.
6.2 Third-Party Components
The Software may include third-party components subject to separate license terms, which apply to those components.
7. Technical Requirements and Performance
7.1 Technical Requirements
The Software may require specific hardware, operating systems, or additional software to function. Licensor does not guarantee compatibility with all configurations.
7.2 Performance Considerations
- Advanced technical skills may be required for setup and operation
- Variability in latency may occur, particularly in dual-PC systems
- Performance may vary based on your specific hardware
8. Term and Termination
8.1 Term
This EULA remains in effect until terminated. Your rights terminate automatically if you fail to comply with any term of this EULA.
8.2 Termination
Licensor may terminate your license without notice if you breach this EULA, if you engage in fraudulent, abusive, or unlawful conduct, or if continued provision of the Software becomes impractical for technical or legal reasons.
8.3 Effect of Termination
Upon termination, you must stop using the Software and destroy all copies in your possession. Except where a refund is required by law, no refunds will be issued for prepaid fees.
9. Limited Warranty and Disclaimer
9.1 No Warranties
THE SOFTWARE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. LICENSOR DOES NOT WARRANT THAT THE SOFTWARE WILL MEET YOUR REQUIREMENTS OR THAT ITS OPERATION WILL BE UNINTERRUPTED OR ERROR-FREE.
9.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL LICENSOR BE LIABLE FOR ANY SPECIAL, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, LOSS OF PROFITS, BUSINESS INTERRUPTION, OR LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE SOFTWARE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
9.3 No Liability for Third-Party Actions
LICENSOR SHALL NOT BE LIABLE FOR ANY PENALTIES, SUSPENSIONS, OR BANS IMPOSED BY THIRD PARTIES (INCLUDING GAME PUBLISHERS OR PLATFORMS) RESULTING FROM YOUR USE OF THE SOFTWARE.
10. Refund Policy
Except where a refund is required by law, all sales are final and the Software is non-refundable. You acknowledge this before purchasing.
Your statutory rights: Nothing in this EULA removes or limits any mandatory consumer rights you may have under the laws of your country of residence. Where such rights apply, they take precedence over this section.
11. User Support

11.2 Support Limitations
Licensor does not guarantee 24/7 support availability, resolution of all technical issues, compatibility with all configurations, or support for issues arising from unauthorized modifications.
12. Updates and Upgrades
12.1 Updates
Licensor may provide updates at its discretion. Updates may be automatic and may be required for continued use of the Software.
12.2 Upgrades
Licensor may offer upgrades for an additional fee, which may be subject to separate terms.
13. Governing Law
This EULA is governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles, except where mandatory law provides otherwise. Nothing in this section deprives you of the protection of the mandatory consumer laws of your country of residence.
14. Entire Agreement
This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Licensor regarding the Software and supersedes all prior understandings, whether oral or written.
15. Severability
If any provision of this EULA is held unenforceable or invalid, it will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will remain in full force and effect.
