These Terms of Service ("Terms") govern your access to and use of the hardware and software products provided by Colorant, LLC ("Colorant", "we", "us", or "our"), collectively the "Services". By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, do not access or use the Services.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live (whichever is greater), and able to enter into a binding contract, to purchase or use the Services. By using the Services you represent that you meet these requirements. The Services are not intended for anyone under this age.
2. License Grant
Colorant grants you a personal, non-exclusive, non-transferable, limited license to use the Services solely as permitted by these Terms. This license is conditioned on your continued compliance with these Terms.
3. Account Responsibilities
3.1 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorized use of your account or any other breach of security.
3.2 Prohibited Account Activities
The following are strictly prohibited and may result in immediate account termination:
- Sharing your account credentials with others
- Attempting to crack, reverse engineer, or bypass our security measures
- Creating new accounts to evade a previous ban
- Operating multiple accounts to circumvent limitations
- Using modified or unauthorized versions of our software
If you have previously been banned, creating new accounts may result in immediate termination. We keep records of banned accounts, hardware identifiers, and associated information to enforce these restrictions, as described in our Privacy Policy.
4. Acceptable Use
4.1 Intended Use
The Services are designed specifically to assist users who experience difficulties with precise mouse movements, including:
- Users who lack the natural dexterity or skill level required for high-performance gaming
- Users with cognitive, neurological, or developmental conditions that affect fine motor control
- Users seeking accessibility solutions to overcome barriers in applications requiring advanced cursor precision
- Users requiring assistive technology to achieve parity with typical performance levels in competitive environments
Important: Software that interacts with online games may breach those games' terms of service or anti-cheat rules, and using it can result in temporary or permanent bans of your game accounts. You are solely responsible for how you use the Services and you use them at your own risk. We do not control, and are not responsible for, decisions made by game publishers or platforms.
4.2 Compliance with Third-Party Terms
You are solely responsible for ensuring that your use of the Services complies with all applicable third-party terms of service, including those of games and other platforms. Colorant bears no responsibility for any violation of third-party terms resulting from your use of the Services.
4.3 Prohibited Uses
You shall not use the Services to:
- Engage in any unlawful activity
- Make unauthorized modifications to the Services
- Interfere with other users or systems
- Violate any third-party terms of service
5. Data Collection and Privacy
Colorant collects certain data, including hardware identifiers and authentication information, for security and operational purposes. How we handle personal information is described in our Privacy Policy. By using the Services, you consent to that collection and use.
6. Disclaimers and Limitations
6.1 No Warranty
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. COLORANT MAKES NO WARRANTY THAT THE SERVICES WILL MEET YOUR REQUIREMENTS OR BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE.
6.2 Technical Requirements
You acknowledge that:
- Advanced technical skills may be required for setup and operation
- Adjustments may be necessary for optimal performance
- Variability in latency may occur, particularly in dual-PC systems
- You are responsible for ensuring adequate network connectivity
6.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, COLORANT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, INCLUDING BUT NOT LIMITED TO ACCOUNT SUSPENSIONS OR BANS IMPOSED BY THIRD-PARTY PLATFORMS.
6.4 Indemnification
You agree to indemnify, defend, and hold harmless Colorant and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or connected with your use of the Services or your violation of these Terms.
7. Payment and Refund Policy
7.1 Payment
Payment for the Services is due in full at the time of purchase.
7.2 Refunds
Except where a refund is required by law, all sales are final and fees are non-refundable. You acknowledge and accept this policy before completing a purchase.
Your statutory rights: Nothing in these Terms removes or limits any mandatory rights you may have as a consumer under the laws of your country of residence (for example, statutory withdrawal or refund rights). Where such rights apply, they take precedence over this section.
7.3 License Duration
"Lifetime" licenses remain active for as long as Colorant continues to operate the relevant Services. We do not guarantee the perpetual availability of the Services.
8. General Provisions
8.1 Modifications to Terms
We may modify these Terms from time to time. When we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
8.2 Termination
Colorant may suspend or terminate your license and access to the Services for non-compliance with these Terms or where reasonably necessary to protect the Services or other users.
8.3 Force Majeure
Colorant will not be liable for any delay or failure to perform resulting from causes outside its reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, government action, labor disputes, or network or internet service provider failures.
8.4 Governing Law and Disputes
These Terms are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law rules, and the state and federal courts located in the State of Delaware shall have jurisdiction over any dispute, except where mandatory law provides otherwise. Nothing in this section deprives you of the protection of the mandatory consumer-protection laws of your country of residence.
8.5 Severability
If any provision of these Terms is held invalid or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
8.6 Entire Agreement
These Terms, together with the Privacy Policy and the EULA, constitute the entire agreement between you and Colorant regarding the Services and supersede all prior agreements and understandings, whether written or oral.
